AI boosts compliance, but human judgment stays critical

Compliance teams in financial services are facing unprecedented pressure as communication volumes soar across chat apps, messaging platforms, and traditional email. Regulatory scrutiny continues to intensify, leaving firms searching for ways to maintain effective oversight without sacrificing accuracy or compliance integrity.

According to Saifr, AI has emerged as a powerful ally, but many organisations make the mistake of either relying on full automation or avoiding it altogether. The real value lies in a balanced approach, combining AI’s data-processing capabilities with human judgment to deliver defensible, regulator-ready surveillance decisions.

AI can rapidly scan communications, identify potential risk indicators, and prioritise alerts for review. However, it lacks the contextual understanding required to interpret nuanced situations. Regulators like FINRA and the SEC emphasise that firms must maintain supervisory systems that are “reasonably designed” to achieve compliance—something automation alone cannot deliver. Human reviewers remain essential to validate findings, apply firm policies, and prevent misinterpretation.

Take, for example, an AI system that flags frequent references to “gift cards” in advisor communications. Without human context, this might suggest a gifts and entertainment violation. A compliance officer, however, can quickly confirm these discussions relate to legitimate client holiday bonuses—well within policy boundaries.

Leading firms are deploying AI as a first line of defence to handle large-scale monitoring tasks, including AML and KYC checks, sanctions screening, and marketing compliance reviews. Natural language processing enables AI to analyse communications for suspicious patterns, prohibited terms, or policy violations.

Yet human expertise remains the final arbiter, especially when intent and context matter. Whether reviewing customer due diligence discussions, resolving sanctions alerts, or validating marketing claims under FINRA Rule 2210, compliance officers ensure findings align with regulatory standards and ethical obligations.

Successful integration depends on robust governance, clear escalation procedures, regular system testing, and comprehensive audit trails. Regulators expect firms to document how AI tools operate, validate outputs, and maintain transparency across decision-making processes.

The rewards are significant. Firms adopting a human-in-the-loop model achieve scalable compliance operations, reduce false positives, strengthen regulatory confidence, and free compliance teams to focus on strategic priorities rather than manual reviews.

As FINRA’s StratIntel team notes, the goal is to “uncover risks and opportunities” through collaborative intelligence—leveraging AI’s efficiency without removing human oversight. Done well, this partnership delivers surveillance capabilities that neither humans nor AI could achieve alone.
