AI adoption is accelerating across financial services and other regulated industries, but governance is struggling to keep pace as firms try to balance innovation with accountability.
Theta Lake’s annual Digital Communications Governance Report suggests the direction of travel is clear, with almost all organisations planning to expand AI use, while many are already running into governance and data security challenges that can slow deployment and raise compliance risk.
Regulatory expectations are also sharpening around how AI tools are used in regulated environments, with an emphasis on continuous oversight rather than one-off controls. That includes monitoring prompts, responses and outputs to confirm tools behave as intended, as well as ongoing risk assessments that feed into updated policies, procedures, controls and systems under relevant requirements.
A central point for regulated firms is that accountability does not change just because a system is generating content. AI-generated communications are still communications, and responsibility sits with the firm regardless of whether a message was created by a person or an AI tool. In practice, that means monitoring is not just a “nice to have” for audit readiness; it is what enables investigations at scale when something goes wrong.
This shift is also tied to regulators’ focus on proving tools continue to perform as expected and result in compliant behaviour over time, not only at launch. To meet that bar, organisations need visibility into real-world prompts and outputs, supported by review processes that can withstand scrutiny. Without that end-to-end monitoring, it becomes difficult to demonstrate effective supervision or explain how issues were identified, escalated and resolved.
Beyond compliance coverage, monitoring plays a practical role in improving AI behaviour, because refinement depends on evidence from live usage. If firms cannot see prompts and outputs in context, they lose the ability to identify performance issues, refine supervisory processes, adjust controls, and improve reliability and accuracy over time—leaving them exposed to drift and inconsistent outcomes.
Retention is another pressure point as AI interaction data may already be captured by enterprise observability and security tooling, but not necessarily in a way that sits inside structured supervisory frameworks. That creates a risk of unmonitored accumulation of sensitive interaction data, and it also makes it harder to decide what should be retained, what should not, and how long records should be kept to meet regulatory and internal requirements.
Traditional surveillance approaches can struggle in this environment, particularly when they rely on static keyword lists and siloed review queues. Those methods are not designed to supervise AI behaviour, detect systemic drift, or demonstrate accountability across a growing volume of AI-mediated interactions, especially when teams need fewer low-quality alerts and more meaningful, investigable signals.
Legacy monitoring was also not built for high-velocity AI interactions, multimodal communications, cross-platform correlation, prompt-level inspection, or contextual replay—capabilities that are becoming increasingly important as communication channels converge and AI becomes embedded into everyday workflows. The direction implied is that monitoring needs to be AI-native, unified and context-aware, rather than bolted onto older tooling.
Theta Lake positions its approach around modern capture and oversight, highlighting “full-fidelity capture” including AI prompts and outputs via system APIs, alongside AI-native risk detection across modalities and unified oversight across voice, chat, video and AI-generated content. The company says its platform can ingest, normalise, correlate and enrich high-volume communication data while supporting observability, reconciliation and forensic-level investigations for compliance teams looking to detect real risk, reduce noise, improve AI behaviour over time, and take a more intentional approach to retention.
The firm also points to ISO/IEC 42001 certification as a trust signal, framing it as evidence of a commitment to responsible AI management and surveillance practices designed to be transparent, accountable and future-ready as regulators continue to raise expectations around AI governance.
