For anyone working in surveillance, records or risk at an EU-regulated financial services organisation, the past few months have brought a familiar mix of urgency and uncertainty.
According to Wordwatch, the EU AI Act’s August 2026 deadline has been widely watched — and widely expected to slip. The Digital Omnibus on AI, still in trilogue at the time of writing, is anticipated to push the main obligations on standalone high-risk systems back to December 2027, with embedded systems following in August 2028. The temptation to breathe a sigh of relief is understandable. It would also be a mistake.
Wordwatch recently delved deep into the topic of what the EU AI Act actually asks of firm’s recording estates.
The dates are shifting. The obligations are not. Communications surveillance tools that score, prioritise or close alerts on the basis of staff communications remain squarely within the Act’s high-risk classification. Three obligations are of particular consequence for this space: traceability of decisions, documentation of training and review data, and auditability of every alert, dismissal and escalation. All three run directly through the recording layer — and all three take considerable time to remediate.
Traceability begins in the data layer, not the model
Articles 12 and 13 of the Act create a compound obligation. Article 12 requires high-risk systems to log events automatically across their lifecycle. Article 13 requires that deployers can interpret what those systems output. Together, they pose a single operational question: can you explain how the model reached its conclusion, and can you point to the underlying record from which it drew that conclusion?
For a communications surveillance tool, that explanation must trace back to the original conversation — intact, with timestamp, channel, participants and chain of custody preserved. If audio was transcoded on ingestion, if chain of custody is reconstructed from spreadsheets after a regulator’s request, or if the underlying record sits on an end-of-support recorder, the model’s output is not defensibly explainable. The Act provides no vendor cover for a deficient data layer.
The practical implication is straightforward. Surveillance vendors will face procurement questions about their recording assumptions. The organisations deploying those tools should expect the same challenge from their own second line of defence — before it arrives from a regulator.
Documentation: provenance is now a regulatory artefact
Article 11 and Annex IV require technical documentation covering the data and data-governance practices used to train, validate and operate any high-risk system. For communications surveillance, that means demonstrating provenance both for training data and for the data against which the model operates in production.
Recordings that lack chain of custody, have compromised original-format integrity, or originate from a recorder whose vendor lifecycle has lapsed represent weak links in that documentation chain. A technically sound model can still fail audit if its underlying data provenance cannot be evidenced. This is not a theoretical risk. Both FINRA’s 2026 Annual Regulatory Oversight Report and the SEC’s 2026 examination priorities explicitly require organisations to demonstrate the provenance of training and review data. Regulatory expectations are converging across jurisdictions, not pulling apart.
It is also worth noting that the Omnibus does not dilute documentation duties. The work that has been delayed is the standards infrastructure that supports compliance — not the compliance obligations themselves.
Auditability is an operational discipline, not an architectural feature
Articles 14 and 17 require that every alert, dismissal and escalation can be reviewed and accounted for. This is a daily workflow obligation, not something resolved at design time. Reviewer actions must be timestamped and attributable. The underlying record they reviewed must be retrievable on demand, in its original form.
Three areas of exposure appear most frequently in practice. Legacy data estates, where recordings exist but lineage is undocumented. Mixed-vendor environments, where reviewers move between consoles and lose the audit thread. And off-channel capture gaps. All three are data-layer problems, and all three tend to surface at the worst possible moment — when an investigation or a regulatory request lands.
The recording layer is the regulatory artefact now
Surveillance AI is only as defensible as the records it operates on. Three of the Act’s most consequential obligations — traceability, documentation, auditability — run through the recording layer. The financial organisations most exposed when the high-risk regime takes effect, whenever that date ultimately proves to be, are not those without surveillance AI. They are those whose recording estate cannot evidence the integrity of what the model saw, scored or dismissed.
The Omnibus delay is not a reprieve. It is a window. The organisations that use it well will treat their data layer as the regulatory artefact it has become.
