Why FINRA’s 2026 report puts AI governance under scrutiny

FINRA’s newly published 2026 Regulatory Oversight Report delivers a clear message to financial firms experimenting with generative AI: adoption is racing ahead, while governance frameworks are struggling to keep pace.

According to Red Oak, across nearly 90 pages of guidance and observations, the regulator repeatedly returns to the same concern – firms are deploying increasingly powerful AI tools without the controls, supervision, and recordkeeping discipline expected in regulated markets.

For many firms, the report serves as a sharp warning. For others, particularly compliance-first technology providers, it confirms a direction they have already taken. The underlying principle running through FINRA’s analysis is simple: the lack of explicit AI-specific regulation does not remove existing compliance obligations. Firms remain fully accountable for how AI is used across communications, supervision, and documentation, regardless of how novel the technology may appear.

FINRA recognises that GenAI is being widely adopted to improve efficiency, particularly in areas such as content summarisation, information extraction, and workflow automation. However, it also outlines a series of risks that could negatively affect investors, firms, or the integrity of markets if left unmanaged. These include AI agents acting without appropriate human validation, systems operating beyond their intended scope, and complex decision-making processes that are difficult to audit or explain. The regulator also highlights the heightened risks around sensitive data handling, privacy, bias, hallucinations, and the limitations of general-purpose AI models that lack deep financial services expertise.

Crucially, FINRA makes it clear that these risks are not theoretical. They are already surfacing as firms test and deploy AI tools without fully developed oversight structures. This creates exposure not only from a regulatory perspective, but also from an operational and reputational standpoint.

Against this backdrop, the report reinforces the importance of embedding governance directly into AI-enabled compliance workflows. FINRA’s position is that innovation does not dilute accountability. AI-driven processes must be subject to the same standards of supervision, transparency, and record retention as any other compliance activity.

The report also underscores the growing expectation that firms can demonstrate how AI decisions are made, how outputs are reviewed, and how records are preserved. Auditability is no longer optional. Regulators want clear evidence that AI tools are being used as supervised extensions of existing compliance programmes, not as unsupervised shortcuts.

Another theme running through FINRA’s findings is the need for domain-specific design. Generic AI tools, while powerful, are unlikely to meet the nuanced requirements of financial services compliance without careful configuration and ongoing human oversight. FINRA’s focus on explainability, scope limitation, and data protection signals that firms must be able to show not just what their AI does, but why and how it does it.

Ultimately, the 2026 Oversight Report positions AI governance as a core compliance issue rather than a future consideration. Firms that delay putting robust guardrails in place risk falling behind regulatory expectations as scrutiny intensifies. FINRA’s message is clear: AI must operate inside the existing regulatory framework, not alongside it.

As more firms evaluate GenAI for compliance review and communications oversight, the report suggests that now is the moment to prioritise supervised, auditable, and regulator-ready implementations. The direction of travel is unmistakable, and those that act early will be better positioned as regulatory expectations continue to evolve.
